State of Connecticut v. XXXX 

CHARGES:

  • Criminal Possession of a Firearm
  • Pistol without a Permit
  • Part B information for Serious Felony Offender (State dropped the Assault in the First Degree charge prior to trial)

FACTS:

Mr. XXXX argued with an individual outside Club Vandome in New Haven, CT. The fight escalated and the other individual pulled out his licensed firearm and fired it at Mr. XXX. Both individuals ran down the street while being chased by police. Further down the street, more shots were fired. The other individual got on the ground and gave himself up to the police. Mr. XXX kept running. The police later apprehended Mr. Terrell in the parking lot of a building one street over. 


The other individual claimed that Mr. XXX fired a gun at him. The police testified they saw Mr. XXXX firing his gun both at the scene of the argument and further down the street. The police seized a firearm from the bushes of the parking lot where they apprehended Mr. XXX. Mr. XXX’s DNA was not found on the firearm.



There was a lengthy Porter hearing on firearm and tool mark identification. State v. XXXX, 2019 WL 2093108, (Conn. Super. Ct. Mar. 21, 2019).

OUTCOME:

  • Not Guilty on all charges
