What is the status of the Roundup lawsuit?
Roundup is still being sold by Monsanto and Bayer, its manufacturer without warning labels related to cancer. Cases continue to be filed throughout the country against the makers of Roundup. This includes cases filed in what is known as the case “In re: Roundup Products Liability Litigation (MDL No. 2741)”. The cases have been consolidated in what is called an MDL or “Multi District Litigation.” This means that one Court has the ability to hear all cases pending against the makers of Roundup for increasing the risk of cancer in people who used or were exposed to the chemical. Roundup has said publicly and has indicated in public filings that it has the intention of settling these cases. It continues to address the cases through litigation and continues to deny that the product causes cancer. When will Roundup settlements be paid?
On July 29, 2021, Bayer and Monsanto announced a
“Five Point Plan” to end the Roundup Litigation. Within that plan the company stated that it has put aside an additional $4.5 billion to “manage anticipated claims, through settlement and litigation.” It is our position that this means that the makers of Roundup are going to work hard to attempt to resolve cases in the near future. The exact time frame of settlements can be difficult to assess. The company has already settled tens of thousands of claims and intends to settle additional claims in the future.
The timeline and pace of settlement will depend on many factors, including the injuries, medical treatment, extent of losses and damages, lost wages, level of exposure and use of the chemical and the law firm you work with. Our law firm has an aggressive plan to ensure the timely resolution of claims. No lawyer or law firm can promise a specific time frame of settlement. Once a settlement agreement is reached, however, payment usually occurs within thirty (30) days.
How long does it take to settle a Roundup lawsuit?
The length of time for the settlement of a Roundup lawsuit depends upon the Court system, the interest in settlement by Bayer and Monsanto, the extent and nature of the injuries and damages claimed and the amount and type of exposure or use of Roundup. The company has indicated that would like to resolve all of the claims made and they have “a clear path to closure [or end] of the U.S. glyphosate litigation.” This plan from the makers of Roundup involves settlement of claims.

What is the average payout for Roundup lawsuit?
The average payout for a claim, which is when a case settles prior to the start of a lawsuit, or a lawsuit settlement, depends entirely on the injuries, treatment, and exposure level a person had to the chemical. For example, a person who worked with roundup on a daily basis, was diagnosed with life-threatening cancer and had chemotherapy, radiation, surgery and is unable to work for the rest of their life has a high case value.
In the case of Pilliod v. Monsanto Company, the Pilliod family was exposed to Roundup and Alva and Alberta Pilliod developed non-Hodgkin Lymphoma. The case went to trial and a jury awarded $2.055 billion in damages, including $55 million in compensatory damages and $1 billion for each person in punitive damages.
In the case of Johnson v. Monsanto, Dewayne Johnson was awarded $289 million in damages by a jury as a result of his exposure to Roundup and developing non-Hodgkin Lymphoma.
Also, in the case of Hardeman v. Monsanto Company, Edwin Hardeman was awarded $80 million in damages after it found that Mr. Hardeman’s exposure to Roundup contributed to his development of non-Hodgkin lymphoma.
Since that time, Monsanto and the makers of Roundup have set aside $11 billion to settle claims according to public records and the New York Times. According to the
New York Times, at least 30,000 cases remain pending and subject to additional settlements.
